1. Who we are
AssetGuard Cam is run by [legal name of the company], [registered address] ("we", "us"). These terms are the agreement between you and us when you create an account or book an inspection. Please read them. If you do not agree, do not use the service.
Contact us on WhatsApp at +1 438 883 5509 or by email at [support email].
2. What we do
We send a vetted local inspector to a property you tell us about. The inspector takes GPS-tagged photos and video and completes a checklist. A regional manager then checks the work and writes a plain-language summary with a grade (A to D) and suggested next steps. You see the report in the app once the manager approves it.
We aim to deliver your report within the number of working days shown when you book. Delays can happen because of weather, access problems, public holidays or safety concerns. We will keep you informed in the app.
3. What a report is, and what it is not
A report is an honest record of what our inspector could see on the day of the visit. It is not:
- a land survey, title search or proof of ownership;
- a valuation;
- an engineer's structural assessment, or a pest, electrical or environmental certificate;
- a guarantee that there are no hidden problems, or that nothing will change after the visit.
Inspectors only look at areas they can reach safely and without damage. They do not open walls, lift floors or test equipment. The grade is our professional opinion based on the checklist. GPS positions from phones can be off by some metres.
4. Your account
- You must be at least 18 years old.
- Give us true and up-to-date details, including a phone number we can reach you on.
- Keep your sign-in details private. You are responsible for what happens in your account.
5. Your property and permission to visit
- You confirm that you own the property, or that you have the owner's permission to arrange an inspection.
- You authorise our inspector to visit, enter where access is given, and take photos and video of the property.
- You are responsible for arranging access, for example by telling your caretaker or tenant about the visit. We never force entry.
- The address, landmarks and contact details you give must be correct. If our inspector cannot find or enter the property because of wrong details or no access, section 7 applies.
6. Prices and payment
- Prices are in US dollars and are shown before you pay. The price you pay is the price you were shown. [Sales taxes: confirm whether GST/HST/QST applies and whether prices include it].
- Payments are processed by Stripe. We do not see or store your full card number. Your bank may charge a fee for paying in US dollars.
- Founding prices are limited to the number of places shown on our pricing page and to the period stated there.
- Monthly plans, when they are available, renew automatically each period until you cancel. You can cancel at any time in the app, and the cancellation takes effect at the end of the period you have paid for.
7. Cancellations and refunds
- Before an inspector is scheduled: you can cancel for a full refund.
- After scheduling: you can move the visit for free up to [24 hours] before it. Cancelling after that: [refund amount, for example 50%].
- No access or wrong details: we offer one free return visit. After that a new booking is needed.
- If we cannot do the inspection within [15] working days of your payment for reasons on our side, you get a full refund.
- If you are unhappy with a report, tell us within [14] days. If the report missed something on the checklist, we will send an inspector again at no cost, or refund you.
- Refunds go back to the card you paid with. Your bank decides how long they take to arrive.
Nothing in this section takes away refund rights you have under consumer protection law where you live.
8. Repairs
If a report shows a problem, you can ask us for a repair quote. A quote lists the real cost of each item, plus a management fee of 15 to 20% for organising and checking the work. No work starts until you approve the quote in the app. Repairs are done by [independent local contractors / our staff]. [Who is responsible for the quality of the repair, and any warranty on it].
9. Our inspectors and managers
We check the identity and references of every inspector and manager before they work for us. [They are independent contractors / employees]. Please pay only through the app, never an inspector directly, and tell us at once if anyone asks you for money.
10. Fair use
Do not use AssetGuard Cam to:
- inspect a property you have no right to inspect;
- watch, follow or harass a tenant, neighbour, family member or anyone else;
- break the law, or put our inspectors in danger;
- copy, resell or interfere with the app.
We may refuse a booking, or close an account, if we believe it breaks these rules.
11. Photos, videos and reports
Your reports, photos and videos are for your own use. You may share them with family, lawyers, buyers or tenants. We keep a copy to run the service, check quality and handle disputes, as explained in our Privacy policy. We will not use photos of your property in our marketing without your permission.
12. Our responsibility to you
We will carry out inspections with reasonable care and skill. To the extent the law allows, we are not responsible for problems that could not reasonably be seen during the visit, or that started after it, or for losses caused by decisions you make based on a report. Where the law allows us to limit our responsibility, the most we will pay for any claim is the amount you paid for the inspection concerned.
Nothing in these terms limits our responsibility where it would be unlawful to do so, or removes rights you have under consumer protection law.
13. Changes to these terms
We may update these terms as the service grows. If a change is important, we will tell you in the app or by email before it takes effect. Bookings you have already paid for stay under the terms that applied when you paid.
14. Disputes and the law that applies
If something goes wrong, please contact us first. We will try to fix it quickly. These terms are governed by the laws of [the Province of Quebec and the federal laws of Canada that apply there]. Any dispute that we cannot settle together will go to the courts of [Montreal, Quebec], unless the law where you live gives you the right to use your local courts.
